How Long Does a U.S. Trademark Take?

Honest expectations instead of a fixed promise.

Trademark applications can take many months, and sometimes longer, to reach registration. The exact timeline varies depending on USPTO examination workload, the specifics of the application, whether an Office Action is issued, whether additional information is requested, and whether any third party opposes the application.

We do not promise a fixed registration time, such as "6 months." Every application is different. What we do provide is status monitoring and clear updates as your application progresses.

General stages an application may pass through

  • Filing and initial USPTO intake
  • Assignment to an examining attorney
  • Examination, which may result in an Office Action requiring a response
  • Publication for opposition, during which third parties can object
  • Registration (for use-based applications) or Notice of Allowance (for intent-to-use applications, followed by proof of use)
