US Trademark Registration From India
Filing assistance for Indian IT firms, D2C brands and startups.
India's IT-services industry, its fast-growing direct-to-consumer (D2C) brand scene, and its large Amazon and Flipkart seller base mean that a great number of Indian businesses now sell products or services directly to U.S. customers — often before they've thought about protecting their brand name in the U.S. market.
Common reasons Indian businesses file a U.S. trademark
- IT-services and software companies with a U.S. client base operating under a firm or product name
- D2C brands in beauty, wellness, food or apparel expanding from Indian marketplaces to Amazon.com
- SaaS startups incorporated in India (or with a U.S. Delaware C-corp) selling to U.S. customers
- Manufacturers and exporters supplying U.S. retailers or distributors under a private or house brand
- Content creators, coaches or consultants building a U.S. client base under a personal or business brand
Indian startup with a U.S. Delaware entity — does that change anything?
It can be relevant. If your actual principal place of business is genuinely in the United States (for example, a U.S.-based flip structure with real U.S. operations), your domicile analysis may differ from a purely India-based company. This is a fact-specific legal question best confirmed with a U.S.-licensed attorney — simply forming a Delaware entity while your business is run from India does not, by itself, establish U.S. domicile.
For applicants domiciled in India, USPTO rules generally require representation by a U.S.-licensed attorney before the USPTO. We help prepare your application and coordinate this required representation. See our full foreign-applicant guide.
What information we'll ask for
- Your proposed trademark (name, logo, or both)
- Whether you're applying as an individual, an Indian private limited company, or a U.S. entity
- Your GST/Udyam registration details, if applying under an Indian business
- The goods/services the mark covers in the U.S. market
- Current or planned use in U.S. commerce
Does this protect your brand inside India?
No. A U.S. federal trademark only creates rights under U.S. law. Protecting your brand in India requires a separate application with the Indian Trade Marks Registry under the Trade Marks Act — a distinct process from USPTO filing.
